Return and refund policy

This policy applies to orders placed with PE Marph GmbH through marph.co. We sell to consumers in the European Union, the United Kingdom and Switzerland, and to business customers. It sets out your right of withdrawal as a consumer, how returns and refunds work, and your statutory warranty rights. Different rules apply to business customers, set out at the end.

Your right of withdrawal (consumers)

If you are a consumer in the European Union or the United Kingdom, you have a statutory right to withdraw from (cancel) your purchase within 14 days without giving any reason (in Austria under the Fern- und Auswärtsgeschäfte-Gesetz – FAGG; in the United Kingdom under the Consumer Contracts Regulations 2013). Swiss law does not give consumers a statutory right of withdrawal for online purchases; we nonetheless grant consumers in Switzerland the same 14-day right on a voluntary, contractual basis, on the terms below.

For goods, the withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, take physical possession of the goods. Where you order several goods in one order that are delivered separately, the period runs from the day you receive the last item.

To meet the withdrawal deadline, it is enough to send your notice of withdrawal before the period expires.

How to withdraw

To withdraw, tell us your decision by a clear statement, for example by email to info@marph.co or by post to PE Marph GmbH, Mariahilfer Straße 187/13, 1150 Vienna, Austria. You may use the model form below, but you do not have to.

Effects of withdrawal

If you withdraw, we will refund all payments received from you, including the standard delivery cost, without undue delay and no later than 14 days from the day we are informed of your withdrawal. We do not refund the extra cost of any non-standard delivery option you chose.

We make the refund using the same means of payment you used for the original transaction, unless we have expressly agreed otherwise with you, and in any event at no fee to you. We may withhold the refund until we have received the goods back, or until you have supplied proof of having sent them back, whichever is earlier.

Returning goods

You must send the goods back without undue delay and in any event no later than 14 days from the day you notify us of your withdrawal. The deadline is met if you send the goods before the 14 days expire.

You bear the direct cost of returning the goods.

You are liable only for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.

Digital products and downloads

For digital content supplied other than on a physical medium (for example downloadable files), you lose your right of withdrawal once delivery has begun, but only if all three of the following are met: you expressly consented to delivery beginning immediately; you acknowledged that you thereby lose your right of withdrawal; and we provided you with confirmation of the contract on a durable medium (for example by email). At checkout you will be asked to give that consent and acknowledgement before access is granted, and we send the confirmation by email. If any of these is missing, your right of withdrawal continues and no payment is due for the digital content, even if you have already downloaded it.

Other exceptions to the right of withdrawal

The right of withdrawal does not apply to goods made to your specifications or clearly personalised. Many of our products can be personalised; where you order a personalised item, you will not have a right of withdrawal for it, and this is made clear to you before you order.

Faulty or incorrect items (statutory warranty)

Separately from the right of withdrawal, you have statutory warranty rights if an item is defective or not as described. The rights that apply depend on where you are: in the EU these warranty rights (Gewährleistung) generally last two years from delivery (VGG and ABGB); in the UK they arise under the Consumer Rights Act 2015; and in Switzerland under the Code of Obligations. If an item is faulty or we sent the wrong item, we will, as the law provides, repair or replace it, or where appropriate reduce the price or take the item back against a refund. We bear the cost of returning faulty items. These statutory rights are not affected by this policy or by any time limit it sets for withdrawal.

Business customers

The right of withdrawal above applies to consumers only. If you buy in the course of your business or profession, you have no right of withdrawal. Returns by business customers are accepted only by prior agreement and at our discretion. Statutory warranty rules for business sales apply.
