These terms govern your use of marph.co and any purchase you make from it. The store and website are operated by PE Marph GmbH ("Marph", "we", "us", "our"). Our full company and contact details are in our legal notice. By placing an order you agree to these terms in the version in force at the time of your order.

Scope and definitions

These terms apply to all contracts concluded through marph.co between you and Marph. In these terms, a "consumer" (Verbraucher) is a natural person acting wholly or mainly outside their trade, business or profession, and a "business customer" (Unternehmer) is anyone who is not a consumer. Where a clause applies only to consumers or only to business customers, this is stated.

Contract language and storage

The contract is concluded in English. We do not separately file the contract text for you to retrieve later; please save your order confirmation and these terms. The current terms are always available on this page.

How a contract is concluded

The display of products on marph.co is an invitation to you to place an order, not a binding offer. When you complete the checkout and submit your order, you make a binding offer to buy the selected items.

The order process is: select your items and add them to the basket, enter your delivery and payment details, review your order on the summary screen, and submit it. Before submitting, you can review and correct your entries using your browser and the on-screen editing functions.

Any automatic email acknowledging receipt of your order does not constitute acceptance. The contract is concluded only when we confirm dispatch of the goods or, for digital products, when we make the product available to you. If we cannot accept your order – for example because an item is unavailable or a price was clearly stated in error – we will tell you and will not charge you, or will refund any amount already taken.

Prices and payment

Prices are shown in euros. For consumers in the EU, prices include statutory Austrian VAT. For deliveries to the United Kingdom and Switzerland, prices are shown without UK or Swiss VAT; as the importer you are responsible for any import VAT, customs duty and carrier handling fee on delivery, as set out in our shipping policy. Shipping costs are not included in the item price and are shown separately at checkout before you pay.

We accept the payment methods shown at checkout, which currently include credit and debit card, PayPal, Klarna and eps-Überweisung. Payment is due on conclusion of the contract unless the chosen payment method provides otherwise.

Delivery and shipping

Delivery areas, carriers, costs and times are set out in our shipping policy. For consumers, the risk of loss or damage passes to you when you, or a third party named by you who is not the carrier, take physical possession of the goods. For business customers, the risk passes when the goods are handed to the carrier.

Right of withdrawal

If you are a consumer, you have a statutory 14-day right of withdrawal. The conditions, how to exercise it, the model withdrawal form, and the rules for digital products – including that you lose the right of withdrawal for downloadable digital content once delivery has begun with your express prior consent and acknowledgement – are set out in our return and refund policy. The right of withdrawal does not apply to business customers, or to personalised items.

Statutory warranty for defects

Statutory warranty rights (Gewährleistung) apply to defective or incorrectly supplied items. For goods, these rights generally last two years from delivery, with the rules for digital content as provided by law. Nothing in these terms limits the statutory warranty or other mandatory rights of consumers. Further detail is in our return and refund policy.

Digital products and licence

Where you buy a digital product, we grant you a non-exclusive, non-transferable licence to use it for your own business or personal purposes. You may not resell, redistribute, sublicense or publish the product or its files, or remove any notices, unless we agree in writing or the law allows it.

Liability

We are liable without limitation for damage caused intentionally or by gross negligence, and for harm to life, body or health. For slightly negligent conduct, we are liable only for the breach of obligations that are essential to performing the contract, and only up to the foreseeable damage typical for this kind of contract. Any further liability is excluded to the extent permitted by law. Mandatory liability, including under the Product Liability Act (Produkthaftungsgesetz), and the mandatory rights of consumers, are not affected by this clause.

Intellectual property

The website, its content and our products are protected by intellectual property rights and remain ours or our licensors'. You may use them only as intended for the purchase you make. You may not copy, reproduce, sell or otherwise exploit any part of them without our express written permission, except where the law allows.

Acceptable use

You may not use the website or its content for any unlawful purpose, to infringe the rights of others, to transmit malware, or to scrape, crawl or circumvent the security features of the site. We may suspend or end access where these terms are seriously breached.

Governing law and jurisdiction

These terms and any contract under them are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence, and the statutory rules on the courts competent for consumer disputes continue to apply. For business customers, the exclusive place of jurisdiction is the court with competence for 1150 Vienna, Austria.

Consumer dispute resolution

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, and we do not participate in such proceedings. If you have a concern, please contact us first at info@marph.co – we aim to resolve complaints directly and quickly.

Changes to these terms

We may update these terms for future orders. The version in force at the time you place your order applies to that order. We will not change a concluded contract to a consumer's disadvantage without their consent.

Final provisions

If any provision of these terms is or becomes invalid, the remaining provisions are unaffected. Our failure to enforce a right is not a waiver of it. These terms, together with the policies they refer to, form the agreement between you and us for your purchase.
